Questions
Which wage level applies to my consultant?
The level depends on the requirements of the job (education, experience, special skills and supervision), not on the person. The pages here list all four levels and do not decide which one applies. Ask the immigration attorney who files the LCA.
Is a prevailing wage the same as a pay rate or bill rate?
No. It is a legal minimum for the wage on a labor condition application. A consultant’s actual pay, and the rate you bill, are set separately and are usually higher than the minimum.
Does an LCA mean an H-1B was approved?
No. A certified labor condition application is one step before the petition. It is not an approval and not a job opening.
Why is the annual figure hourly x 2,080?
DOL publishes hourly wages. Two thousand and eighty is 40 hours for 52 weeks, the convention used to convert them to a yearly figure. Gross pay, before tax.
